1. GENERAL AGREEMENT

“PETITE KINGDOM” Ltd. is a company registered in Latvia, registration No 40203318669, VAT exempt No. EN 40203318669; registered office: Riga Street 1-37, Talsi, LV-3201, Office address: Jaunā iela 12, Piņķi, LATVIA. The terms and conditions laid down, terms of delivery, terms of return of goods, other terms and conditions and operational policies, the outline of which can be found on the Home page, in relation to certain functions, elements or advertising, as well as providing customer service, and all listed are included in these terms and conditions (all collectively referred to as Terms and Conditions) and are part of a part. By authoring the E-SHOP section of the Home Page, you acknowledge that you have read these Terms and Conditions, understand them, and agree to comply with them without restrictions and conditions.

If the consumer acquires, through the Internet, children’s and maternal goods, clothing, accessories, footwear and other goods offered on THE home page OF PETITE KINGDOM, hereinafter – Goods, such mutual agreement shall be regarded as a Distance Agreement and shall be subject to the legal norms of the Republic of Latvia which govern the Distance Agreements, including but not only, the Law of the Republic of Latvia “Consumer Rights Protection Law”, the Cabinet Regulations of Ministers of the Republic of Latvia, “Regulations regarding Distance Contract”.

If the customer who ordered and purchased the product on the Home page does not have legal capacity, the lawful representative of that person (e.g. parents, trustees) shall be responsible for the order and payment of the product. In the above case, the order cannot be withdrawn and the purchase fee made cannot be refunded.

A distance contract regarding the purchase of Goods shall be deemed to have been concluded with the time of payment of the goods.

2. PRIVACY

PETITE KINGDOM protects the fundamental rights and freedoms of individuals, in particular privacy, with regard to the processing of personal data in accordance with Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC.

PETITE KINGDOM Processing your personal data in different ways for a number of purposes, depending on whether you are a registered user (see page Point 2.2), unregistered user (see page Point 2.3), you have applied for news (see page Point 2.4) or purchase a gift card (see page Point 2.5). Information related to the use of cookies (the English “cookies”) is available in the Cookie Policy.

PETITE KINGDOM shall not use or share the information obtained which you provide online without a legal basis. PETITE KINGDOM is obliged to disclose personal data to officials of the State and local governments in the cases specified by law. We will be forced to disclose the consumer’s personal information when required by law.

PETITE KINGDOM may process your personal data in a aggregated manner for statistical purposes in order to analyse and improve the services and products provided.

PETITE KINGDOM shall take all possible measures to protect your personal information against theft, disappearance, abuse, and against unauthorised access, detection, alteration and damage.

2.1. GENERAL RIGHTS

Under the legislation in force, you have the following rights:

request access to your personal data;
request to correct or delete your personal data as far as it is possible;
request to limit or object to the processing of your personal data;
request the transfer of your personal data as far as possible;
withdraw your consent to the processing of personal data at any time;
submit a complaint to the national personal data protection authority
contact PETITE Kingdom and obtain additional information on the processing of your personal data.

2.2. REGISTERED USER

2.2.1. CREATE AN ACCOUNT

When you register on the Home page and create your client account, hereinafter called “Account”, your personal data is used to enter into an agreement with PETITE KINGDOM on the creation and maintenance of an Account that is used as a communication channel for entering into a Distance Agreement.

When creating an Account, you are informed that the data you entered is processed to create and maintain an Account, including to create and maintain your wish list and purchase history, and to send you information related to the performance of the Distance Agreement, such as order execution information, order specifications.

PETITE KINGDOM needs to receive and process your personal data so that you can enter into a Distance Agreement using the Account as a channel of communication. If you do not provide this personal data, you will not be able to create an Account and enter into a Distance Agreement.

In addition, the information in your Wish List and Procurement History is used to improve THE services and product offers provided BY PETITE KINGDOM, based on PETITE KINGDOM’s legitimate interest in collecting information on the quality of the services and products offered.

The information on Distance Contracts (products purchased) in your account, including all communications with you, is maintained as proof that the Distance Agreement has been concluded and performed. This information IS retained by PETITE KINGDOM on the basis of a legitimate interest in protecting its rights and interests in the event of a dispute and the obligation imposed by law to keep information on the commercial activities carried out.

Your personal data related to the creation and maintenance of an Account and the conclusion and execution of a Distance Agreement shall only be processed by PETITE KINGDOM and our liaison partners that provide order delivery, IT structures and payment platforms. The minimum amount of personal data required shall be transferred to the co-operation partners.

Your personal data under this objective shall be processed until you delete the Account, or until the period of storage of data specified in the legislation of the Republic of Latvia or the limitation period for bringing an action before the court, whichever is the later.

2.2.2. RECEIVING COMMERCIAL COMMUNICATIONS

When you apply for a commercial notification, such as Goods Shares, Special Offers, you agree that PETITE KINGDOM processes your personal data, which you specify on the Registration Form and the Order Form, including your geographical location and purchasing history.

PETITE KINGDOM processes your personal data to send you current and appropriate commercial communications. PETITE KINGDOM carries out various types of profiling, gathering the information you provide to analyse what services and products you might be interested in and sending you a commercial statement of suitable content.

If you purchase Goods on the Home page, PETITE KINGDOM uses your e-mail address to send commercial messages for similar items even if you have not applied for commercial messages. If you do not want to receive such messages, you may opt out of further use of your e-mail address to send commercial messages in a separate e-mail message immediately after you complete the order, as well as at each time you receive a commercial message.

Your personal data related to the sending of commercial communications shall only be processed by PETITE KINGDOM and our liaison partners providing IT structures and email platforms. The minimum amount of personal data required shall be transferred to the co-operation partners.

PETITE KINGDOM stops sending commercial messages as soon as your request is processed. However, keep in mind that processing the request depends on the technological capabilities to meet your request, which may take up to five days.

2.2.3. FEEDBACK

When you leave a feedback on Item, you agree that your name, the rating assigned to the Item, and the feedback that you have left are published on the Home page. If you have created an Account using the ability to register through Facebook, your picture is also displayed in a reduced format.

The personal data mentioned above are processed with a view to publishing the feedback on the Home page and to improving the quality of the services and products provided BY PETITE KINGDOM. Reviews published on the home page are deleted only if the product in question is no longer offered.

PETITE KINGDOM may, if necessary, contact you by telephone or by electronic means to resolve problems with the service or product for which you have left your reference. After contacting you, PETITE KINGDOM will not continue to use your phone number or email address in connection with your feedback.

Your personal data related to the publication of the feedback shall only be processed by PETITE KINGDOM and our liaison partners providing IT structures. The minimum amount of personal data required shall be transferred to the co-operation partners.

2.3. UNREGISTERED USER

2.3.1. CONCLUSION OF A DISTANCE CONTRACT

For the purpose of entering into a Distance Agreement, PETITE KINGDOM is required to receive and process the personal data specified in the order form. If you do not provide your personal data, you will not be able to enter into a Distance Agreement.

PETITE KINGDOM collects and stores information about your purchase history with a view to improving the services and products provided, based on PETITE KINGDOM’s legitimate interest in collecting information on the quality of the services and products offered.

Information related to the conclusion and execution of the Distance Agreement, including all communications with you, shall be maintained as proof that the Distance Agreement has been concluded and performed. This information IS retained by PETITE KINGDOM on the basis of a legitimate interest in protecting its rights and interests in the event of a dispute and the obligation imposed by law to keep information on the commercial activities carried out.

Your personal data related to the conclusion and execution of the Distance Agreement shall only be processed by PETITE KINGDOM and our liaison partners that provide order delivery, IT structures and payment platforms. The minimum amount of personal data required shall be transferred to the co-operation partners.

Your personal data within the scope of this objective shall be processed until the period of storage of data specified in the legislation of the Republic of Latvia or the limitation period for bringing an action before a court, whichever is later.

2.3.2. RECEIVING COMMERCIAL COMMUNICATIONS

When you apply for the receipt of commercial statements, such as Goods Shares, Special Offers, you agree that PETITE KINGDOM processes your personal data, which you specify in the order form, as well as your geographical location and purchase history.

PETITE KINGDOM processes your personal data to send you current and appropriate commercial communications. PETITE KINGDOM performs profiling by collecting information about your geographical location and purchasing history to analyse what services and products you might be interested in and to send you a commercial statement of suitable content.

Because you purchase Goods on the Home page, PETITE KINGDOM uses your e-mail address to send commercial messages about similar products even if you have not applied for commercial messages. If you do not want to receive such messages, you may opt out of further use of your e-mail address to send commercial messages in a separate e-mail message immediately after you complete the order, as well as at each time you receive a commercial message.

Your personal data is processed for this purpose until you withdraw your agreement to receive commercial communications or refuse to receive commercial communications. Information about withdrawal or refusal of consent will be stored in order to properly comply with your request not to send commercial communications. PETITE KINGDOM stops sending commercial messages as soon as your request is processed. However, note that the processing of the request depends on the technological capabilities to meet your request, which may take up to five days.

2.4. NEWS RECIPIENT

By agreeing to receive news in e-mail, you agree that PETITE KINGDOM sends commercial communications, such as Stock and Special Offers, to your designated e-mail address.

PETITE KINGDOM stops sending commercial messages as soon as your request is processed. However, note that demand processing depends on the technological capabilities to meet your request, which may take up to five days

3. HOMEPAGE ACTION GOAL

This website has been created and maintained by PETITE KINGDOM and its distribution partner. The website is designed to effectively serve as a platform for communication between the company and the customer, as a platform for online marketing of branded products and as a source of information on all issues related to production and business.

4. PRODUCTS AND SERVICES FOR PERSONAL USE

The products available on this website that we can provide you with are intended solely for personal use. You must not sell or sell to third parties. PETITE KINGDOM reserves the right, with or without notice, to withdraw or reduce the volume of any executable order or of the products or services to be provided to you in cases where this may, in our unilateral view, result in a breach of the rules and conditions.

5. ACCURACY OF INFORMATION

When providing a description, package leaflet or size of the products available on the home page, we shall endeavour to be as accurate as possible and to provide appropriate information on receipt of the product manufacturer concerned. If changes have been made to the information related to the product (description, colour, size, material and so on), PETITE KINGDOM cannot guarantee that the website has been fully updated at any moment, including all current information.

5.1. COLOR OF GOODS

PETITE KINGDOM shall make every effort to ensure that the colour placed on the home page corresponds to the information provided by the product manufacturer. The color of the items is marked both when you purchase products and the corresponding pictures are inserted, and can be listed in the description of the items. However, we cannot guarantee the match of color to the product against the color match on your smartphone, PC, tablet, or other devices based on screen settings.

6. INTELLECTUAL PROPERTY and patent

All information and content available on this website, including, but not limited to, trademarks, logos, service marks, text, graphic marks, button icons, images, sound recordings, data aggregates and software, their aggregation and layout (all collectively referred to as Content) are property of PETITE KINGDOM, partners or license sensors, and it is protected by the laws of the Republic of Latvia and other international laws relating to the protection of intellectual property, including the laws governing the use of copyright and trade marks. Without explicit written permission, the use of trademarks belonging to us in any way, regardless of purpose, is not permitted. The trademark and logo is a PETITE KINGDOM patent. The design of the home page shall be regarded as the property of PETITE KINGDOM and shall be prohibited from copying or use for selfish purposes without THE written consent of PETITE KINGDOM.

7. PRICING POLICY

On the www.petitekingdom.com webpage, all prices are denominated in euro (EUR). All prices are subject to VAT or other trade duties, if any, provided for (including customs duties levied on consignments outside the European Union). Depending on the delivery address, additional delivery costs may be applied to the order, which will be clearly identified before the payment is approved and will be included in the total costs.

We are trying to ensure that prices are always accurate, but we cannot guarantee that the prices indicated at the time of the order will be constant based on the spotlights of the share and the campaigns at that time.

The final price of the item, including taxes and duties, as well as delivery or postal costs, will be indicated before the Distance Agreement is concluded.

If delivery or mail costs cannot be calculated in advance, you will be informed that such payments may be applied.

8. SUPPLY ARRANGEMENTS

We are ensuring a rapid and secure supply to all European countries. Each country has delivery time and delivery opportunities. If you don’t see your country on the list, be sure to contact us and we’ll help you complete the mailing to your required address and country. We invite you to familiarise yourself with the delivery costs, which are reflected in the Country of Supply and the costs table.

PETITE KINGDOM will prepare your order within 1-3 working days, confirming it by email. Please check your delivery address and selected delivery options. Your goods will be shipped to DPD or DHL courier service providers. If an item address is entered incorrectly or erroneously, sorry, we can’t provide a quick and secure delivery to your preferred address. If you have not received the shipment within 30 days of the date of the order, please contact our customer service so that we can resolve the issue for you.

9. TERMS OF RETURN OF GOODS AND RIGHT OF WITHDRAWAL

Each issue related to the return of orders by the customer and delivered to it is dealt with separately in accordance with the simplified procedure. For information on the customer’s options for returning products and obtaining information on termination and the relevant conditions, we invite you to consult our “RETURN OF GOODS” rules.

10. USER RESPONSIBILITIES

When accessing or using a home page, you must comply with the Terms and Conditions set out herein and the special warnings or instructions for access or use published on the Home page. You must always act in good faith and in accordance with law and custom. You must not make any changes or corrections to the Home page, the contents or services contained therein, or you must not harm the functional or functional integrity of the Home page in any way. 13. PROCEDURES FOR DISPUTE SETTLEMENT

Contracting Parties shall endeavour to resolve any dispute which, in any way, relates to your authorization on the Home page or arises in connection with the execution, clarification or termination of this Distance Agreement in mutual negotiations.

PETITE KINGDOM will respond to any of your submissions in accordance with the procedures and within the time limits specified in the regulatory enactments and will inform you of the possible form of enforcement of the claim or the solution to the dispute or the alternative way the claim is settled.

PETITE KINGDOM does not in any way prejudice your right to apply to the competent national authorities for the protection of your rights.

14. GENERAL PROVISIONS

You agree that these terms and conditions make up all the current agreements between you and PETITE KINGDOM regarding the use of this website and its contents on your part.

Since PETITE KINGDOM is a growing company and is developing, it is right to rectify and clarify these rules at any time by publishing the relevant changes to the Home page. Any changes made to these Regulations and Conditions shall take effect immediately after their publication. You agree that when you continue to use the Home page after making such changes, you hereby certify your agreement to any changes.

15. FORCE MAJEURE

PETITE KINGDOM is not responsible for delaying or defaulting on obligations or other types of non-compliance due to circumstances and obstacles outside our reasonable control, which includes, but not limited to, strikes, pandemics, mayors, government orders, hostilities or national emergencies, threats of terrorism or acts of terrorism, the environment or malformations, third party non-compliance, Internet connection interference, and computer equipment and software failures. In the event of such a force majeure, we will try to prevent the delays that have occurred as soon as possible.
